Sub: -  Inclusion of Gramin Dak Sevaks of Department of Posts under the purview of the proposed Seventh Pay Commission – regarding.

With due respect and regards, we put forth the following for your kind consideration and favourable decision please.

In the Department of Posts, the 50% of the total work force are called as Gramin Dak Sevaks and they are continuously being discriminated by separate committees formed for the consideration of their wages and service conditions.

The Supreme Court of India declared that these Gramin Dak Sevaks are holder of civil posts and it is a well settled law. Despite the judgment, the same civil servant status has not been accorded yet to them except a part in case of disciplinary proceedings.

The Fourth Central Pay Commission categorically emphasized that, the GDS issues shall be brought under the purview of Pay Commissions. But still separate committees are constituted.

The last committee constituted at the time of Sixth Central Pay Commission caused clear injustice to these employees and they are deprived all the service benefits at par with civil servants even though the law of the land declared and settled them as the holder of the civil posts.

Under these circumstances, we most humbly request the Hon’ble Prime Minister of India to consider our request and cause orders to include the GDS of the Department of Posts under the terms of reference of the Seventh Central Pay Commission.

Dear Comrades,

            The National Secretariat of the Confederation congratulate the affiliates and State Committees for the strenuous efforts put in by them to propagate and campaign amongst the mass of the employees of the need for an immediate wage revision and setting up of the 7^th CPC and enlist the massive participation of the Central Govt. employees for a long drawn out struggle, which commenced in 2011 and the first phase of which was culminated on 12^th December, 2012 in a one day strike action.  We are proud of the fact that our efforts has borne fruit  as the Government  had to announce the setting up of the 7^th CPC  on 25^th. Confederation, as you are aware, had always been in the forefront in formulating demands of the CGEs, presenting and articulating the issues in spearheading struggles and negotiating the demands to reach settlement.  This time also Confederation was the organization which raised the setting up of the 7^th CPC and wage revision; demanded that the 7^th CPC’s recommendation must be effective from 1.1.2011; insisting that the tenure of the recommendation of the 6^th CPC must be ended on the expiry of the five years on par with the wage tenure of the Public Sector undertaking workers as early as in 2010.  It could justify the demands with facts and figures of the unprecedented erosion of the real value of the wages of the Central Government employees due to the high rate of inflation in the economy and shooting up of the prices of all essential commodities.  The campaign and propaganda unleashed by us together had its salutary impact on the thinking process of other sister organizations, compelled them to take note of the growing discontent amongst the rank and file of their membership and to realize the fact that the wage structure had become incapable of making both ends meet especially for those employees at the lower levels of the hierarchy. They had to perforce take up the issue of wage revision  and setting up the 7^th CPC due to the ambience created by the Confederation and its affiliates by organizing series of struggles during  the period and at the same time spurning every of our attempt for a joint action. We are quite aware that sanctions cannot be generated without joint and united action of the workers.  This dichotomy practiced by the predominant organizations in the JCM inflicted irreparable damage to the cause of the Central Government  employees.

We are happy that the Government of India having realized that the large majority of the Central Government employees have become mentally attuned to the path of an inevitable struggle on wage revision  decided to avert a confrontation by announcing the setting up of the 7^th CPC.   We must, however, realize that the decision of the Government  tantamount to a post dated cheque which is capable of encashment only after a long period of two and half years.  We must not take it lying down.  The agony and sufferings of the employees, especially those at the lower levels cannot be mitigated by promises and assurances.  There must be a rise in their emoluments to make them capable of meeting the ever increasing cost of essential needs.  The Government must be told categorically and compelled to agree for the merger of DA with pay; and interim relief, which had all along been the case ever since the advent of the system of Pay Commission for wage revision.  We must bring home the fact that there will be no question of any arrears arising from the recommendation of the 7^th CPC as the Commission is mandated to make its recommendation before the crucial date of 1^st January, 2016. 

Even though, it is stated that the terms of reference would be finalized in consultation with all stake holders, the question of inclusion of GDS within the ambit of the Pay Commission, in all probabilities would be resisted by the Government. In the light of the passage of the PFRDA Bill in the Parliament, the Government might not agree to include the retirement benefits in the terms of reference.  This apart, the Government will now refer all pending matters, be it at the National Anomaly Committee, National Council or various Departmental Councils  or taken up through inter departmental references  to the 7^th CPC.  In other words for the next two and half years none of the issues of the CGEs will be either discussed or settled.  We must not allow the Government to succeed in this nefarious objective.

We must note that the present announcement of setting up of the 7^th CPC has also the hidden political agenda, for  many States including  Delhi  are to go to polls in the next few months.  The National Secretariat of the Confederation will meet on 23.10.2013 at Delhi. Formal notice is being sent separately. The Sectt. will decide upon the future course of action. In view of the present announcement of the Government setting up the 7^th CPC it is necessary that we should defer the strike ballot decision, which is scheduled to be held on 11^th to 13^th November, 2013.  It is however, our considered opinion that unless we tread the path of struggle the demand for merger of DA with pay, date of effect, inclusion of GDS within the ambit of the 7^th CPC and other issues in our charter of demands will not be settled at all.   The campaign chalked out must, therefore, be carried out with determination and understanding that we will succeed.   We request the leaders of the affiliates, State Committees and National Sectt. Members to ensure that the campaign programmes are implemented as planned.

GDS bonus ceiling raised from Rs.2500 to Rs.3500 from this year itself...........

FLASH NEWS .... !!!! GDS bonus ceiling for Rs.3500- has been approved by the Cabinet today. The bonus is sanctioned with prospective effect i.e., from this year itself. PIB News: Enhancement of ceiling for calculation of ex-gratia bonus payable to Gramin Dak Sevaks  The Union Cabinet today approved the proposal of the Department of Posts to enhance the ceiling for calculation of ex-gratia bonus payable to Gramin Dak Sevaks from Rs. 2,500/- to Rs.3,500/- same as that prescribed for the regular departmental employees. The decision would be applicable with prospective effect that is from the accounting year 2012-13 payable in 2013-14. The increase in bonus calculation ceiling will restore the long established parity between regular departmental employees and Gramin Dak Sevaks on the issue of payment of bonus. This decision will benefit 2.63 lakh Gramin Dak Sevaks working in the Department of Posts, who play a very vital role in providing postal, financial and insurance services in the rural, hilly and tribal areas of the country.  *****

இதற்கு முன்னர்  நமது 12.12.2012 வேலை நிறுத்தத்தை உடைக்க வேண்டும் என்ற தீய எண்ணத்தில் 10.12.2012 அன்று  தோழர். மகாதேவையா  தனது வலைத்தளத்தில் GDS  ஊழியர்களுக்கான  போனஸ்  உச்சவரம்பை  உயர்த்தும் கோப்பு நிதி அமைச்சகத்தால் ஒப்புதல் தரப்பட்டது  என்ற அறிவிப்பை வெளியிட்டது  உங்களுக்கு நினைவிருக்கும் .

ஆனால் நமது NFPE  சம்மேளனத்தின் மூலம் அன்றைக்கே , இது தவறான தகவல் என்றும் ஊழியர்களை  திசை திருப்ப மகாதேவய்யாவால்  நடத்தப் படும் நாடகம் என்று  தெரிவித்திருந்ததும் உங்களுக்கு நினைவிருக்கும். உண்மையில் அந்த கோப்பு நமது இலாக்காவுக்கே திருப்பப் பட்டது என்றும் நாம் தெரிவித்திருந்தோம்.

"  Now the Department of Posts has constituted a Committee of officers to make fresh study of the case and submit fresh proposal to the Finance Ministry for consideration and approval. The Postal Board has assured the JCA (NFPE + FNPO) that the study will be completed quickly and fresh proposal will be submitted to Ministry of Finance. Definitely the JCA will take necessary follow up action."

Any establishment can employ contract workers in any job or process unless it is prohibited under section 10 of the Contract Labour (Regulation & Abolition) Act, 1970. However, the establishments engaging contract workers have to follow the statutory provisions contained in labour laws. 

No centralized data in this regard is maintained. The period and norms of contract labour depends on the term and conditions of the contract or work/job between the Principal Employer and the contractor/worker. 

As per Rule 25(2) of the Contract Labour (Regulation & Abolition) Central Rules, 1971, the wages of the contract labour shall not be less than the rates prescribed under Minimum Wages Act, 1948 and in cases where the contract workers perform the same or similar kind of work as the workmen directly employed by the principal employer of the establishment, the wage rates, holidays , hours of work and other conditions of service shall be the same as applicable to the workmen directly employed by the principal employer doing the same or similar kind of work. The liability to ensure payment of wages and other benefits is primarily that of the contractor and, in case of defaults, that of the principal employer. 

In case of complaints, field offices of Chief Labour Commissioner (Central) Organization investigate and take action. Social security aspects of contract workers under Employees Provident Fund and Miscellaneous Provision Act, 1952 and Employees State Insurance Act 1948 are enforced by the Employees Provident Fund organization and Employees State Insurance Corporation respectively provided the establishments in which outsourced workers are working are covered under the said Act. 
This information was given by Minister of State for Labour & Employment Shri Kodikunnil Suresh in the Lok Sabha today in reply to a written question.

15 நாட்களுக்குள் பதில்  அளிக்கப்படவில்லை எனில் , தொழிற்சங்கம் மூலமாக அந்தந்த ஊழியரின் மனு நகலை இணைத்து அந்தந்த பணி  நியமன அதிகாரிக்கு புகார் செய்யவும் . 15 நாட்களுக்குள்  இதற்கும் பதில் அளிக்கப் படவில்லை எனில் , இரண்டு  மனுக்களின் நகல்களையும் இணைத்து ,

GDS BONUS - LATEST POSITION

Secretary, Department of Posts held discussion with Secretary Generals of NFPE and FNPO and all the General Secretaries of affiliated Unions/Associations on 02.08.2013 at Dak Bhawan, New Delhi. GDS Bonus case was discussed in detail. Secretary, Department of Posts, informed that Postal Board has again sent the file for approval of the Finance Ministry after replying all the queries raised by Finance Ministry. On behalf of AIPEU, GDS (NFPE) Com. P. Pandurangarao, General Secretary attended the meeting. Minutes of the meeting will be published later.

POSTAL JCA MEETING ON 2.8.13 WITH DG (POSTS) ON GDS DEMANDS

DISCUSSION ON ITEMS OF MEMORANDUM SUBMITTED BY PJCA ON 01-04-2013:

Today JCA leaders had a meeting with Ms.P.Gopinath,Secretary, Posts and Members of Postal Services Board along with other Officers of the Department to discuss on the items in the Memorandum submitted by JCA on 01-04-2013.

The Secretary Generals NFPE & FNPO and all General Secretaries of affiliated Unions participated in the discussion. 

On behalf of AIPEU-GDS(NFPE), Com.P.Pandurangarao, General Secretary attended the meeting.

The following are the outcome of the discussion on GDS issues :

1. Bonus Ceiling : File again sent to Ministry of Finance with replies to the queries made by MoF.

2. Cash handling norms : Circles asked to report on the financial implications to change the work load norms of the BPMs.

3. Reduction in TRCA : Even though Protection for one year is instructed,  it will be reviewed accordingly

4. Compassionate appointments :It is informed by the Official side that after revising the previous calculation of merit marks, the present attributes for merit marks resulted in increase of percentage of appointments. So there is no scope for immediate relief on this issue.

5. Redeployment of GDSMM : the work establishment of GDSMM will be reviewed on their retirement / promotion, further decision will be taken by the Department.

6. Cash conveyance allowance : it will be reviewed on information obtained from the circles.

7. Introduction of Health scheme :  Proposal is under examination by the Finance Ministry. Approval is expected soon.

8. Norms for RPLI : It is clearly mentioned in the instructions on workload norms, 10 transactions – 1 point, but for procuring new business of RPLI as incentive is being given, no separate time factor is given.

9. Norms for cash conveyance from BO to AO vice versa : it will be reviewed.

The third successive struggle program of AIPEU-GDS (NFPE) on 32 Charter of Demands, Dharna infront of Dak Bhawan, New Delhi has been staged successfully with the participation of General Secretaries of affiliated Unions of NFPE, NFPE office bearers and CHQ office bearers of GDS Union.

Dharna program was presided by Com.I.S.Dabas, General Secretary, P-IV (CHQ) and inaugurated by Com.Giriraj Singh, President, NFPE & General Secretary, R-III. Com.M.Krishnan, Secretary General, NFPE & General Secretary, Gr.C., Com.K.V.Sridharan, Leader, JCM (Staffside) & former General Secretary Gr.C., Com.K.Raghavendran, former Secretary General, NFPE, Com.S.Raghupathi, Asst. Secretary General, NFPE, Com.T.Satyanarayana, General Secretary, AIP AEA, Com.Appanraj, former General Secretary, AIPSBCOEA, Com.R.Sivannarayana, President, Gr.C (CHQ), Com.N.Subramanyan, Dy. General Secretary, Gr.C (CHQ), Com.Balwinder Singh, Financial Secretary, Gr.C (CHQ) and comrades of Delhi Circle were participated.

Vyas, Advisor, in his opening remarks, explained the background of events which led to the formation of a Joint Council of Action of Railway (AIRF) Defence (AIDEF) and Confederation and also pointed out its weaknesses and limitations. He stressed the need to further strengthen the unity. He opined that on the 15 point charter of demands, Confederation must conduct its own independent campaign and agitational programmes. If the Railway and defence Federations come forward for serious agitational programmes including indefinite strike we must join such campaign and strike action.

Com. K. Raghavendran, Ex-Working President, Confederation also addressed the meeting. Thereafter discussion on all agenda items took place.

The following are the main highlights and decision of the National Secretariat meeting

1.      Review of 24^th National Conference held at Kolkata from 4^th to 6^th May 2013

2.      15 Pointes charter of demands and future course of action.

The meeting decided to organize independent campaign and agitational programmes culminating in indefinite strike. The specific decisions were:

(i) To organize state level joint strike conventions of C-o-C with the participation of all affiliated unions/Associations/Federations during the month of August 2013. Where ever the C-O-C functioning is not satisfactory or has no participation of district units, efforts must be taken to revamp the committee.

(ii)  To organize mass Relay dharna at different places in all important stations during the first week of September 2013 (from 02.09.2013 to 07.09.2013).

(iii)To conduct nationwide strike ballot during the last week of September 2013 (On 25, 26 and 27^th September)Model of the ballot will be sent later.

(iv)To convene the Central Working Committee/Central Executive committee meetings of all affiliated unions/Associations/Federations before the 1^st week of October 2013. All India Office Bearers of the Confederation may be invited to attend the meeting.

3.      Joint programme of AIRF, AIDEF and Confederation:

It was decided to make all out effort to further strengthen the Joint council of action (JCA) and also to launch serious agitational programmes culminating in indefinite strike before December 2013.

4.      Formation of State Committees and District Committees

It was decided to reorganize the COCs which are defunct or not functioning satisfactorily. This is to be done when the state level strike campaign conventions are organized. Participation of representatives of all affiliates should be ensured in the conventions.

5.      Conducting of All India Mahila Convention of the Confederation.

It was decided to conduct two day’s All India Mahila Convention at New Delhi in the 3^rd week of October 2013. C-O-C Delhi has agreed to host the Mahila Convention. Delegate fee shall be Rs.600/- per delegate. Participation of maximum number of Lady comrades from all states/affiliates should be ensured.

6.      Organising Trade Union Education Camp:

It was decided to hold the Trade Union Education Camp at Mumbai in November/December 2013. Number of participants shall be 150 (maximum). Delegate fee Rs. 600/- per delegate Postal, ITEF, Audit & Accounts and Atomic Energy delegates accommodation shall be arranged by their respective Federations. C-O-C Mumbai shall function as the Reception committee. Date and Venue will be intimated later.

7.      Publication of journal

Decided to publish a monthly journal. Name of the journal shall be “CONFEDERATION NEWS” (subject to availability at RNI) Editorial Board shall consist of Com. S. K. Vyas (Advisor) Com. K. K. N. Kutty (President) Com. M. S. Raja (Working President) Com. M .Krishnan (Secretary General) com. K. P. Rajagopal (Secretary) and Com. Vrigu Bhattacharjee (Financial Secretary).

8.      Financial Review:

Financial Secretary shall present the actual picture in the next meeting. Meanwhile letters should be sent to all affiliated unions to remit the arrears of quota immediately.

9.  National Convention of Central Trade Unions on 6^th August 2013.

The available National Secretariat members/leaders at Delhi will attend the convention on 6^th.

President, Com. K. K. N. Kutty in his concluding remarks, briefed decisions taken in the meeting. The meeting ended at 5 PM.

IMPLEMENT THE DECISIONS

All office Bearers, State Committees, other C-O-Cs and Affiliated Unions/ Associations/ Federations are requested to implement the above mentioned decisions of the National Secretariat meeting, WITHOUT FAIL.
