GRANT OF FLOOD ADVANCE TO THE EMPLOYEES WHO WERE AFFECTED DURING THE DECEMBER 2015 FLOOD THROUGHOUT THE STATE

தமிழக அரசு மாநிலம் முழுதும் வெள்ளம் பாதித்ததாக அரசாணை வெளியிட்டது. அதன்படி வெள்ள  நிவாரணம் வழங்கிட வேண்டி CPMG அவர்களை கேட்டுக் கொண்டோம். அவரும் உடனடியாக உத்திரவு வழங்குவதாக சொல்லி  GFR விதி 64 மற்றும் 66 ஐ சுட்டிக் காட்டி SR  AO மூலம்   உத்திரவு வெளியிட்டார்.  

பின்னர் வெள்ளம் பாதித்த  மாவட்டங்களுக்கு மட்டும் முன்பணம் வழங்குவதாக  தெரிவித்தார்.  இதில் பாண்டி தூத்துக்குடி  திருநெல்வேலி மாவட்டங்களையும் சேர்க்க  நாம்  வேண்டினோம். பரிசீலிப்பதாக CPMG அவர்கள் கூறினார். 

பின்னர் அனைத்து மண்டலங்களில் இருந்தும்  விண்ணப்பங்கள் கோரப் பட்டு அதன் அடிப்படையில், நிதி ஒதிக்கீடு தேவை  என்று  DIRECTIRATE க்கு எழுதியுள்ளதாக தெரிவித்தார். இது  வெறும் ADVANCE என்பதால்  நிதி   ஒதுக்கீடு  தேவையில்லை என்று நாம் கூறினோம். 

இருந்தபோதும் பிரச்சினை DTEக்கு   எடுத்துச் செல்லப்பட்டது . இரண்டரை மாதங்கள் கடந்தபின்  அங்கிருந்து  பதிலும் வந்தது. மீண்டும்  குழப்பம். தற்போது கோடை வந்துவிட்டது.  வறட்சி நிவாரண நிதி  கேட்டு  மாநில அரசு மத்திய அரசுக்கு  கோரிக்கை அனுப்பியுள்ளது . 

இந்த சூழலில் நமது  மாநில நிர்வாகம்  வெள்ள முன்பணம்  வழங்கிட மாநிலம் முழுதும் உள்ள அனைத்து PMGக்களுக்கும் ஒரே மாதிரியான  உத்திரவை வெளியிட்டுள்ளது. அதற்கு நம் மாநிலச் சங்கத்தின் நன்றியை  தெரிவித்துக் கொள்கிறோம்.  

ஆனால்  ஏற்கனவே வெளியிட்ட உத்தரவையே மீண்டும் புதிதாக வெளியிட்டுள்ளது. அதாவது மீண்டும்  GFR  விதிகளை  முன்னிறுத்தியே இந்த உத்திரவு வழங்கப்பட்டுள்ளது. 

இதற்கு இரண்டு மாதங்கள் தேவையில்லை என்பதே நமது கருத்து. இது கீழ் நிலையில் உள்ள  பல அதிகாரிகளால் தவறாக  பயன்படுத்தப்படக் கூடாது  என்பதை உறுதி செய்திட வேண்டி  மாநில நிர்வாகத்திற்கு வேண்டு கோள்  வைக்கிறோம். 

எனவே , மாநில அலுவலகத்தில் வழங்கப்பட்டது போல  விண்ணப்பித்த  எல்லா ஊழியர்களுக்கும் எந்தவித RESTRICTION ம்  செயல்படுத்தப்படாமல் முன்பணம் வழங்கிட மாநில நிர்வாகத்தை வேண்டுகிறோம். உத் திரவின் நகல் கீழே பார்க்கவும்.

 GDS ஊழியர்களை NFPE சம்மேளன உறுப்புச் சங்கமான GDS (NFPE) சங்கத்தில்உறுப்பினர்களாக இணைக்க முழுமுயற்சி எடுத்து முதன்மை சங்கமாக வருவதை உறுதி செய்ய வேண்டுகிறோம்

All of you are aware that the All India Postal Employees Union – GDS (NFPE) was formed in the year 2012. Now almost four years are going to be completed since the formation. During this peiod, the Federal Council of NFPE, which is supreme decision making body of NFPE has decided to grant “ASSOCIATE MEMBERSHIP” to the new union. The All India conference of all affiliated Unions / Associations of NFPE also decided to extend full cooperation and support to AIPEU GDS (NFPE).

The AIPEU-GDS(NFPE) has formed Circle/Divisional Branches in 80% of the Circles and Divisions. It’s first All India Conference was held at Chennai in March 2013 and 2nd All India Conference at Shimla in September 2015. It has conducted various agitational programmes including strike along with NFPE and Confederation.  Due to the efforts made by the NFPE & AIPEU-GDS(NFPE) both Confederation of Central Govt Employees & Workers and the National Joint Council of Action (NJCA) of JCM Staffside  organizations (Railways, Defence, Confederation) have included the demand for grant of Civil Servant status and grant of all benefits of regular employees on pro rata basis in their strike charter of demands as an important demand. Postal Joint Council of Action (NFPE & FNPO) has also included the GDS demands as number one demand in their charter of demands.

The ‘recognized, GDS union is not a part of NFPE or Confederation. It is an individual – self centered organization. During the last 15 years the recognized GDS union could not settle any of the demands of the GDS. Upto 2000, GDS conducted joint struggles including strike under the banner of NFPE and whatever benefit has come to the GDS is only because of the struggles conducted by NFPE. After 2000 the GDS Union started separate functioning and started to divide regular employees and GDS. It is refused to join the joint programme of NFPE and always conducted separate programmes. Recognized GDS Union chould not settle any of the demands of the GDS, instead the GDS lost their existing benefits one by one. The Gramin Dak Sevaks have lost faith in the recognized GDS union and it has become a dead-horse. Now majority of GDS are convinced that only through joint struggle under the banner of NFPE, we can make improvement in the wages and service conditions of Gramin Dak Sevaks.

It is in the above background, the importance of new GDS union is to be understood. The new GDS union AIPEU GDS (NFPE) believes and stand for the joint functioning and struggle along with the NFPE and Confederation. NFPE has already given clear instructions to all Circle, Divisional Secretaries to form the AIPEU GDS (NFPE) in all Divisions and Circles. The AIPEU Group-C (CHQ) and AIPEU Postmen & MTS (CHQ) have also given instructions to all P3 & P4 Divisional, Circle unions to form the AIPEU GDS (NFPE) in the Circle/Divisions.

GDS membership verification orders will be issued in February/March 2016. We have no doubt that the AIPEU GDS (NFPE) will become the number one recognized GDS Union. The authorization letter (i.e., declaration form) should be obtained from each individual GDS and to be countersigned by the Divisional Secretary or Authorized Representative of AIPEU GDS (NFPE). Only Divisional Secretary or Authorized Representative can countersign the Authorisation letter. Hence the formation of the Divisional Union or an ad hoc Committee with a Convener in all Divisions is the first prerequisite for Membership verification.

As per the Constitution of NFPE, P3 & P4, all the Circle Secretaries and Divisional Secretaries of P3 & P4 should implement the decisions of NFPE, P3 & P4 CHQs. Inspite of clear instructions by NFPE CHQ and P3, P4 CHQs some of the Circles and Divisions have not formed the Branches of new GDS Union i.e., AIPEU GDS (NFPE).

Divisional Secretaries of P3 & P4 are still conducting meetings jointly with the old GDS union which is not an affiliate or Associate member of NFPE. The managing bodies of NFPE, P3 & P4 have decided to take disciplinary action against those Circle/Divisional unions for non-implementation of the decisions of NFPE, P3 and P4 CHQs including withdrawl of recognition. Hence this letter is issued.

All Circle / Divisional Secretaries of P3 and P4 are once again requested to implement the following decisions before 20-03-2016 WITHOUT FAIL.

1.       Form Divisional Union or Adhoc Committee of AIPEU GDs (NFPE) in all Divisions. If it is an Adhoc Committee, one convenor should be elected.
2.       Intimate the name, designation, office address with pincode & Mobile Number of the Divisional Secretary or Adhoc Committee Convenor to the (1) Secretary General NFPE
(2) General Secretary AIPEU Group ‘C’ (CHQ)
(3) General Secretary AIPEU Postmen & MTS (CHQ)
(4) General Secretary, AIPEU GDS (NFPE),

It is further instructed that , hereafter if any Divisional Union of P3 & P4 conduct joint programme with any/GDS Union which is not an affiliate or Associate member of NFPE, it will be viewed seriously and disciplinary action (including withdrawal of recognition) will be taken for violation of directions of NFPE, P-3 & P4 CHQ.

Dear GDS Comrades,

The One man Committee headed by Shri Kamalesh Chandra asked to submit feed back from all Gramin Dak Sevaks. Letter addressed to all GDS in English & Hindi also.

It is informed to our CHQ in many Circles / Divisions the local administration asked our GDS comrades to send their views to divisional heads to forward to the GDS Committee through administration also.

AIPEU GDS (NFPE) prepared one model copy on all GDS demands/issues for the information and awareness of the GDS comrades to forward it to Shri Kamalesh Chandra, Chairman, GDS Committee individually from each GDS with their address and signature.

The copy shall be posted to the Chairman, GDS Committee at the earliest from GDS in all divisions in all Circles.

All CHQ office bearers / Circle Secretaries / Divison & Branch Secretaries / Representatives of AIPEU GDS (NFPE) is requested to circulate the copy among GDS members and request them to send the same to the Chairman, GDS Committee by their own from BOs as early as possible.

Further requesting our NFPE leaders in the divisions to cooperate and guide the GDS comrades in the divisions to send the feed-back to the GDS Committee at an early date.

With due respects and regards, we submit the following for your kind consideration and favourable recommendations to the Govt.

1. Departmentalization of GDS by declaring them as Civil Servants and grant all benefits of regular employees on pro rata basis.

2. Change the nomenclature of GDS as “Gramin Dak Karmachari” or “Rural Postal Employees”.

3. Considering the need and requirement of Rural Post Offices after modernization viz., Core Banking Solutions (CBS), Core Insurance Solution (CIS) and introduction of handheld computers at BOs and additional responsibilities, the working hours of all BOs may be extended to 8 hours and all GDS may be granted full time Civil Servant status. There should no combination of duties. The illegal condition that GDS shall not on duty for more than five hours should be removed.

4.  Minimum five hour wages should be paid even if the work load is less than 5 hours and if work load is more than five hours wages for full time (8hours) should be paid. Nomenclature of TRCA should be changed and it should be called as ‘Pay’. There should not be any reduction in wages under any circumstances.

5. The Branch Postmaster shall be paid at the pro rata wages of Postal Assistants; GDSMD/GDS SV shall be paid equal to Postmen; and all other categories with the comparison of MTS. GDS shall be appointed and not engaged and the word ‘engagement’ shall be deleted in the existing rules.

6. Time bound promotion (ACP) to higher pay scale on completion of 10 years, 20 years and 30 years may be granted to GDS. Point to Point fixation is requested for senior GDS. The pay shall be fixed to the seniors in the revised pay based on the number of years of service rendered to that extent by granting notional annual increments. The percentage of annual increment shall be at par with regular employees to whom the comparison is being made. The nomenclature of increment shall be introduced in the place of ‘future entitlement’.

7. The GDS may be considered for grant of HRA, Transport Allowance, Split duty Allowance on pro rata basis at par with regular departmental employees whom we are comparing for wage fixation. The rent of the building in which BO is housed may be paid by the department.

8. TA/DA may be granted to GDS if ordered in the interest of service and all other Allowance like Boat Allowance, SDA, may be extended to GDS.

9. The GDS shall be covered with the Children Education Allowance and hostel subsidy at par with regular employees.

10.The GDS shall be covered under the CS (MA) Rules or a new set of rules equal to that which provide full reimbursement of medical expenses to the GDS and their families.

11.  The GDS may be granted leave on the following norms.
(i)    E.L – One Day for each completed calendar month with accumulation.
(ii)   HPL – 20 days per year, with accumulation facility.
(iii)  Commuted leave may be introduced.
(iv) Maternity leave – 180 days at par with regular employees with full pay & allowances. Pay shall be made from salary head and not from the welfare fund of GDS.
(v)   Child care leave shall be granted at par with regular employees.
(vi)  Special Disability Leave – As applicable to regular employees.

12.Notwithstanding our claim of introduction of pension scheme at par with regular employees prior to 01-01-2004, we request to modify the S.D.B.S scheme to the extent of 10% recovery from the officials; 20% from the department. Ex-gratia gratuity shall be granted on completion 10 years service. Family pension shall also be introduced.

13.All vacancies in the departmental posts viz. MTS, Postmen, shall be filled only by GDS and there shall be no other open market direct recruitment. In respect of PA cadre, the GDS possessing Qualifications and computer knowledge shall be permitted to write the competitive exam along with postman & MTS for the Departmental Quota vacancies.

14.The GDS Conduct & Engagement rules 2011 shall be scrapped and CCS (Conduct) Rules 1964 may be made applicable to GDS also. It shall be covered under Article 309 of the Union Constitution.

15.50% of the past services of GDS shall be counted as regular service on promotion for pensionary benefits including gratuity.

16.GDS shall also be covered under LTC Scheme to have recreation in life.

17.GDS may be provided with uniforms and also grant of Washing Allowance.

18.All advances like festival, medical, LTC, Tour TA, scooter, HBA, Motor Cycle Advance shall be extended to the GDS. All incentives, honorariums shall be introduced for the excess work performed by GDS.

19.Furnishing of security bond shall be dropped. Similarly the residential condition may also be dropped in the recruitment rules.

20.Transfer facilities may further be liberalized; there shall be no loss of service or pay on transfer. Identity cards to GDS are a must and that shall be supplied to GDS free of cost of the Department.

21.Compassionate appointment may be granted to the dependents of deceased GDS, removing the existing conditions.

22. GDS may be granted all Trade Union rights at par with regular employees.

23.The amount payable under Group Insurance Scheme may be enhanced to five lakhs.

24.The 50 years age limit for appearing for departmental examination may be removed.

25. One point may be granted for Rs.4000- of cash handling in BOs.

We submit that these poor and down trodden 2.76 lakhs of Gramin Dak Sevaks should not be neglected and shall be extended with all benefits applicable to departmental employees. As Justice Talwar Quoted that ‘the weak and downtrodden need protection’. We hope that the respected Chairman, GDS Committee will look in to the prayers made by the All India Postal employees Union GDS (NFPE) also we made in the pre paras and render justice to this down-trodden section of the Postal employees.

NJCA INDEFINITE STRIKE FROM 11th APRIL-2016

இரயில்வே உள்ளிட்ட அனைத்து ஊழியர்களின் கூட்டமைப்பு சார்பில்NJCA) 35 கோரிக்கைகள் அடங்கிய கடிதம் கேபினட் செயலாளர் அவர்களுக்கு அனுப்பப்பட்டு அக் கடித நகல் கூட்டமைப்பு உறுப்பு சங்கங்களுக்கு அனுப்பப்பட்டுள்ளது  
      இப் போராட்டத்தில் நமது கோரிக்கை 4இல் 10 வது கோரிக்கையாக வைக்கப்பட்டுள்ளது. அதில் GDS ஊழியர்களை இலாக்கா ஊழியர் என  அறிவிக்கப்படவேண்டும், இலாக்கா ஊழியர்களுக்கு இணையான அனைத்து சலுகைகளும் மேலும் ஓய் ஊதியம் உள்ளிட்டவைகள் வழங்கப்படவேண்டும் என்ற கோரிக்கை வைக்கப்பட்டுள்ளது

            The NJCA met on 08.02.2016 as scheduled. The meeting after taking into account various factors decided that the proposed indefinite strike will commence from 11.04.2016 if no settlement is brought about on the charter of demands by that time. The meeting also took the following decisions.

1.    Strike notice will be served by the NJCA and all its constituents on 11.03.2016 by holding massive demonstration.
2.    There will be a massive Rally on 11.03.2016 at Delhi and leaders of NJCA will make it possible to attend the said rally and the strike notice will be served on Cabinet Secretary, Government of India.
3.    All the National JCA leaders will attend Rally at the State Capitals/big industrial centres during the month March and April, 2016. Dates will be finalised in consultation with the concerned State JCA.
4.    To strengthen the campaign, the NJCA will place on the website a pamphlet explaining the demands.
5.    Posters will be centrally designed and kept in the website for State JCAs and constituents to adopt.
6.    All Constituents will undertake independent campaign programmes in the month of March 2016 to popularize the demands.
7.    29th March will be observed as solidarity day throughout the country unitedly by all the Constituents of NJCA.
8.    The indefinite strike will commence at 6 am on 11.04.2016.
9.    The updated Charter of Demands on which the indefinite strike is to be organized is enclosed.
10. The Constituent organizations may add sectional demands as Part B of the Charter of Demands of the NJCA
            The National JCA appeals all constituents to make intensive campaigns to make the strike an unprecedented success.

1.    Settle the issues raised by the NJCA on the recommendations of the 7 CPC sent to Cabinet Secretary vide letter dated 10th December 2015
2.    Remove the injustice done in the assignment of pay scales to technical/safety categories etc. in Railways& Defence, different categories in other Central Govt establishments by the 7 CPC
3.    Scrap the PFRDA Act and NPS and grant Pension/family Pension to all CG employees under CCS (Pension) Rules, 1972 & Railways Pension Rules, 1993
4.    i) No privatization, /outsourcing/contractorisation of governmental functions
ii) Treat GDS as Civil Servants and extend proportional benefit on pension and allowances to the GDS
5.    No FDI in Railways & Defence; No corporatization of Defence Production Units and Postal Department.
6.    Fill up all vacant posts in the government departments, lift the ban on creation of posts; Regularise the casual/contract workers
7.    Remove ceiling on compassionate ground appointments
8.    Extend the benefit of Bonus Act,1965 amendment on enhancement of payment ceiling to the adhoc Bonus/PLB of Central Government employees with effect from the Financial year 2014-15
9.    Ensure Five promotions in the service career of an employee
10. Do not amend Labour Laws in the name of Labour Reforms which will take away the existing benefits to the workers
11. Revive JCM functioning at all levels

            We have written under the cover of the NJCA’s letter in No JJCA/2015/7th CPC dated 11th December 2015 our comprehensive suggestions for effecting changes in the recommendations of the 7th CPC. This was also subjected to discussion with the JS (A) of DOPT on 11.12.2015 in response to the letter in No 3/1/2015-JCA dated 10-12-2015.
            We request that the same may be treated as the consensus view of the Staff Side, JCM/National Council.
